A wine merchant from Aachen has won a lawsuit before the administrative court against the city's closure order. According to the ruling issued a few days ago, his activity is considered "food trading", which may not be restricted. The city of Aachen had argued that the term "food" only covers "the urgently needed foodstuffs of daily use", but not luxury foods. The judges took a different view on this.
According to the judgement, the term "food" was "to be understood comprehensively" and therefore not limited to the basic supply of the population. By adhering to strict hygiene requirements, the spread of the coronavirus could be contained in all food stores - including ice cream parlours and delicatessens. The City of Aachen has accepted the ruling. It had it declared that wine shops, delicatessens and ice cream parlours may now reopen under very strict infection protection guidelines.
There is currently no uniform jurisdiction in the federal states. The rules and their interpretation vary greatly in the cities, districts and federal states.
